Anti-Gambling Group Files Suit to Stop DraftKings, FanDuel in NY

An anti-gambling group called Stop Predatory Gambling has filed a lawsuit this week claiming that New York lawmakers violated the state constitution in allowing Daily Fantasy Sports sites DraftKings and FanDuel to re-enter the market.

Last October New York Attorney General Eric Schneiderman ordered the two companies to cease operating in the state, claiming they were in violation of gambling laws.  Since that time, the Assembly and Senate passed legislation declaring daily fantasy sports to be games of skill, not chance.  In August, Gov. Andrew Cuomo signed off on the legislation.

“The Legislature does not have the power to change the constitution,” said coalition attorney Neil Murray. “Only the people do.”

While the coalition’s lawsuit seeks to overturn the new law, it does not seek an injunction that would block the sites from operating while the case is argued, Murray added.
